Is Kentucky a No-Fault State for Auto Insurance?

The answer is YES.

But, what does that mean?

It means that no matter whom is at fault for an automobile collision in the state of Kentucky, if you have car insurance, there are certain benefits your automobile policy provides the driver and all passengers. You should call your insurance agent after any collision to find out what benefits you have under your policy. 

The automobile coverage may include Personal Injury Protection or PIP coverage. This benefit is available to anyone that purchases automobile insurance with PIP coverage. PIP coverage provides payment for medical expenses and lost wages up to $10,000.00 per person. There is a maximum of $200 a week for lost wages and you will need a doctor’s “off work” note.

What does this coverage provide for you if you don’t have health insurance? It means that getting treatment for your injuries after an automobile collision is a must, if you experience any pain. You can get assessed by a medical professional without worrying about the medical bills. Personal Injury Protection payments are to be used for just that – to pay your medical bills up to $10,000.00, that are a result of the collision, no matter whom is at fault.

For automobile collision injury claims, if you are over 18, the claim must be either settled or filed in Court within two years of the collision, or within two years of the last PIP payment. To be eligible to file a claim for personal injuries in Kentucky, the claim must meet one of the following: 1) the injured person must have at least $1,000 in medical expenses; 2) a broken bone; 3) permanent disfigurement; 4) permanent injuries; or 5) death. If you do not meet one of these criteria, a personal injury claim cannot be made for your injuries.
