Fatal drunk driving crash leads to 8 year prison sentence

This week, a woman was sentenced to an 8-year prison term for her role in the drunk driving death of a 36-year-old Ohio woman. The incident occurred on Independence Day of 2013. The 36-year-old woman was driving an SUV on U.S. Route 50 when she was struck nearly head-on by the intoxicated woman.

Doctors attempted to save the woman's life, but she succumbed to her injuries the following day. An autopsy reported that she had been hit with "tremendous force"; the woman apparently struck the air bag so hard that her lungs burst.

The other driver was arrested for OVI. When a Ohio Highway Patrol officer asked the woman whether she had been drinking any alcohol, the woman allegedly replied, "plenty." Her blood-alcohol content was later shown to be more than double the legal limit.

The criminal case against the woman came to a close this month with the 8-year prison sentence, which was the maximum possible. The woman will have to serve all eight years before she will be eligible for release. The sentence was possibly increased by the fact that the woman has allegedly committed three OVIs in the past, though charges were dropped on at least one of those offenses. The family of the victim also accused the woman of failing to show remorse for her actions.

Often in cases like this, the criminal case is only half of the battle. In many cases, families of fatal accident victims also pursue civil charges against the negligent party that caused the collision. These wrongful death charges can provide monetary compensation for the losses that the family has suffered, including funeral expenses, lost wages and repayment for the pain and suffering that the family has been forced to endure.
